Colorado: Vote AGAINST Amendment 80

Who is responsible for the education of children?

Traditionally, the United States acknowledged that the responsibility of educating children fell primarily on the parents of that child. This common consensus can be seen in Supreme Court rulings like the 1925 decision Pierce vs. the Society of Sisters, and in the Merriam-Webster 1828 dictionary definition of “educate.” The definition explicitly states, “To educate children well is one of the most important duties of parents and guardians.”

However, today, many of our leaders are offering a different answer to this question. They argue that it is primarily the government’s job to ensure that children are properly educated. Consider what James Dwyer, a Professor at the William & Mary School of Law, stated in an interview: “The state needs to be the ultimate guarantor of a child’s wellbeing.” Even President Joe Biden said in a speech to public school teachers, “They aren’t someone else’s, they are all our children.” Furthermore, our current education climate is dominated by the public school system, state regulations on education, and crackdowns on independent education. It is clear that, in the eyes of our leaders and legislatures, parents are no longer primarily responsible for the education of children.

This past year, this worldview shift took root in the great state of Colorado. In fact, this November, citizens of Colorado will vote on Amendment 80, which, if passed, would enshrine this novel idea into their state constitution. What is Amendment 80? What would be its effects? Should voters in Colorado support it in November? All of these questions, and more, must be considered by the citizens of Colorado so that they can be prepared to vote either “Yes” or “No” when the ballot comes their way.

Amendment 80

Amendment 80 reads, “Section 1. In the Constitution of the State of Colorado, add section 18 to Article IX as follows: section 18. Education – school choice (1) purpose and findings. The people of the state of Colorado hereby find and declare that all children have the right to equal opportunity to access a quality education; that parents have the right to direct the education of their children; and that school choice includes neighborhood, charter, private, and home schools, open enrollment options, and future innovations in education. (2) Each k-12 child has the right to school choice.”

Briefly put, this amendment seeks to enshrine four claims in the state constitution:

  1. All children have the right to equal opportunity to access a quality education.
  2. Parents have the right to direct the education of their children.
  3. School Choice includes neighborhood, charter, private, and home schools, open enrollment options, and future innovations in education.
  4. Each K-12 child has the right to School Choice.

While these things may sound appealing, there are severe implications that must be considered before you vote on Amendment 80.


A Warning to Colorado

Parental rights vs. Child’s rights

The amendment is centered around the idea of a child’s right to quality education. The first problem, of course, is that if you give children rights, then you practically abolish parental rights. Parental rights” are a negative right, while a so-called “child’s right to education” is a positive right. Carolyn Martin, Director of Government Relations for Christian Home Educators of Colorado (CHEC), defined a negative right in her article Right to an Education? as “the requirement of someone else not to interfere in your ability to obtain something.” Conversely, Martin explains that positive rights “are a requirement of someone else to provide you with something.”

Parental rights require the government to ensure that nothing obstructs a parent’s ability to fulfill their God-given responsibility to raise and educate their children. This right is turned upside down. If we implement “a child’s right to education,” suddenly it becomes the government’s responsibility and jurisdiction to provide “quality education” for all children everywhere. The immediate effect of this is the government can no longer “stay out of the way.” It must oversee, regulate, and manage the education of all children to ensure that a child’s so-called “right to quality education” is protected. As soon as we permit the government to oversee our children, we abolish parental rights.

How is “quality education” defined in Amendment 80?

The second problem with Amendment 80 is the vague language of “quality education.” The big question this amendment fails to answer is, who gets to define “quality education”? UNESCO (United Nations Education, Scientific and Cultural Organization), the globalist organization that is actively working to globalize education, defines quality education as DEI education. Their website says that it is their job to “Ensure inclusive and equitable quality education and promote lifelong learning opportunities for all.” When you sit down to educate your children, is teaching them diversity, equity, and inclusion your top priority? Hopefully not. But that is the priority of the elites who openly work to control your child’s education.


Parental rights require the government to ensure that nothing obstructs a parent’s ability to fulfill their God-given responsibility to raise and educate their children.


While the state of Colorado may not adopt UNESCO’s radical view of “quality education,” we must recognize that its definition has the potential to be hostile to a classical, Christian education. Most likely, its definition will look more like the public school system where the Bible is banned from classrooms, sex education is taught for all ages, and patriotism is cast to the side in exchange for progressivism.

In short, this amendment would enshrine in the Colorado Constitution that “The government is responsible for the education of your children.” This is such an egregious assault on parental rights and the natural law that organizations like CHEC are speaking out against this amendment and warning parents about the severe implications.


Protect Education Independence in Colorado!

In November, it is up to the voters of Colorado to protect your state from this blatant infringement on parental rights. Educate yourself on the amendment, share this information with your friends and family, and vote “NO” this November to protect your education independence.

Right to an Education?

There has been an international push over many decades to create a right of education for children. The United Nations (UN) through UNESCO (United Nations Educational, Scientific and Cultural Organization) has been at the forefront of this push and they have established several treaties beginning in 1960 with the UN Convention Against Discrimination in Education. Interestingly, the United States (US) has declined to ratify these treaties. Homeschoolers fought hard against the ratification by the US Senate of the United Nations Convention on the Rights of the Child (UNCRC) since it was signed by the Clinton administration in 1995. Despite this, individual states and the federal government have been implementing various aspects of these treaties through their lawmaking process for years.

Parental Rights or Rights of the Child

In Colorado, we have seen for some time now a shift away from parental rights to the rights of a child, including when it comes to education. There have even been some attempts this year to put the right of a child to a quality education in the Colorado Constitution. Under the biblical order of the family, it is parents who steward the rights of children until they are capable of handling the responsibility of exercising their rights on their own.

Positive Rights vs. Negative Rights

Attorney Kevin Boden, from HSLDA, gave those who attended the class at CHEC’s Homeschool Day at the Capitol a quick lesson on the difference between positive rights and negative rights. Negative rights are the requirements of someone else not to interfere in your ability to obtain something. He referred us to the 4th Amendment guarantee to be secure from unreasonable searches and seizures without probable cause. The government is responsible for making sure they do not infringe on our right of property. Positive rights are a requirement of someone else to provide you with something. Here, he referred to the 6th Amendment right to a speedy trial, which the government must provide through its taxpayer-funded judicial system.

The parental right to direct the upbringing, care, and education of their children is a negative right. The government must secure that fundamental right given to us by God and not infringe upon it. A right of a child to a quality education is a positive right. It would require the government to provide for the education and ensure the quality of it. Home education would be subjected to greater scrutiny because the government would have a duty to evaluate the quality and content of the education being provided by the parents. Nature’s law is based on negative rights, not positive rights, but the world system is trying to move all nation states toward the positive rights structure through the UN treaties.

Ideas have Consequences

Ideas have consequences, and we must be careful to choose wisely what ideas we support and stay true to God’s order for the family and education. As the election season heats up, let’s make sure we ask probing questions of those who want to represent us! Do they support parental rights, and what does that mean to them? Do they know the difference between children’s rights and parent’s rights? How will they ensure we have the freedom to home educate our children without government intrusion?

Our parental rights are in danger, and we must stand together to preserve them.

And So It Begins Again – The Fight Against Government Control

The march toward more government programs, government control over our families and livelihoods, and restrictions on our inalienable rights has begun. Last year was bad enough, but despite this being an election year, those who run our government have not finished implementing their complete transformation of our beautiful state. And so it begins again: today is the first day of the 2024 legislative session. 

Parental Rights & Religious Freedom Relinquished to Government Control 

Parents have relinquished their rights in exchange for the rights of the child. Special rights, ostensibly granted to oppressed groups, have overshadowed religious liberty. What about homeschooling? So far, we have kept the dam from breaking on our freedom to educate our children how we see fit. Yet, there is much opposition coming from many directions. State alphabet soup agencies, departments, and boards. School choice and anti-homeschool advocates. Local school officials and boards. Legislators on both sides of the aisle. 

Stand With Us 

There is no way I can withstand them alone. I rely greatly on God’s help to see and understand these attacks. But each of you also plays an integral part. First and foremost, this is a spiritual battle. God’s enemies hate what He has created – especially children, the family, and the church. Homeschooling is a lifeboat for the preservation of our families and our faith. You must stay true to His call to raise your families in the admonition of the Lord, or everything you do is meaningless. Pray to God for His protection and provision for me and every homeschooling family in this state. 

Commit to Stay Informed and Engaged! 

Unfortunately, I foresee many liberties being taken away from us this year. Let us ensure that the ability to homeschool without government control is not one of them! We have experienced God’s faithfulness since the enactment of the homeschool law thirty-five years ago. As we ask the Lord to show us what it means to be eternally vigilant and how to safeguard what He has given us, it will require sacrifice from each of us.

Colorado: Meet Your Legislator Day on February 15

Laws, Rules, and Guidance

It is vital that homeschoolers meet their legislators and participate in Homeschool Day at the Capitol and Legislator Day events to protect homeschooling freedom. The legislature solely holds the authority to make laws, while the Executive Branch departments or agencies set the rules for implementing and enforcing those laws. They then use their rules to create guidance on how to follow the rules and comply with the law.

Over the past several years, the Colorado Department of Education (CDE) has been working on revising the rules around public school financing. The broad rule-making authority has been given to the State Board of Education (BOE) to promulgate rules around part-time programs (CRS 22-54-103(10)(e.5)). The BOE, an elected body, will be reviewing and voting on these rules in February. These changes will impact some part-time public-school programs utilized by homeschoolers.

Changes to Part-Time Programs?

Teacher Qualifications: Technically, they have not changed their guidelines around teacher qualifications for schools receiving funding. At the BOE meeting on December 13th, the CDE representative said they merely moved some of the language from their guidance document into the rules for clarity. School districts, charter schools, and BOCES can still receive waivers to allow teachers who do not have a teacher’s license to teach classes. Additionally, they made it clear in the rules that classes where the parents are the teachers will not be funded.

Eliminate K–5th Grade Online Part-Time Programs: They will no longer fund part-time pupils for asynchronous supplemental online learning for K–5th grade students. This is a change from current policy but is within their authority to decide. Those students must enroll in an online district school to receive those types of services.

Contracts With Instructional Providers: According to CDE, local school districts, charters, and BOCES have the authority to contract with third parties to provide educational services. From what they said, the proposed rules do not change the local control aspects of this provision, but they do add more accountability to these programs by adding additional documentation and hoops for them to go through to be funded.

Impacts on Independent Homeschoolers?

As long as a homeschool family does not enroll in a public-school program, these rules do not apply. While the attitude of education bureaucrats remains opposed to our right to homeschool, these rules do not threaten the homeschool law. But, as Treon Goossen, one of the co-authors of Colorado’s homeschool law, wrote concerning the danger of the emergence of part-time public-school programs, “The public school system wants the public/parents to believe that ‘it is all homeschooling’ so when they make their move to eliminate the control of parents over their independent homeschools and thrust them back under state control — it will appear to be the most natural thing to do.” (Read the full article and connect the dots.) She contended that these programs are a threat to our liberties.

As you know, CHEC works closely with HSLDA on all matters related to homeschooling. HSLDA’s position is that the current proposed rule changes only affect taxpayer-funded public programs and do not threaten the homeschool law. Additionally, HSLDA does not support tax-payer-funded public programs as the programs themselves have the potential to undermine private home education. CHEC and HSLDA will continue to work to ensure homeschooling families remain as free as possible from government control.

Remember: what the government funds, the government controls. CHEC envisions families honoring Jesus Christ by embracing Christ-centered home discipleship and free from government control. We will continue to monitor these rules as they move through the process and keep you informed.

Vote for Liberty

A few people have asked for my recommendations for upcoming school board seats up for election. I know of some good people running, and I will give you their names in a heartbeat because I have much respect for them. However, in the spirit of full disclosure, I am convinced that school board elections are a waste of good people, time, and resources in the year 2023.

State School Snare: Incapable of Giving You the Tools Needed to Flourish

Government schools are captured on so many levels. Unfortunately, there is little chance for reform. Even if you gave the necessary people, time, and resources to the cause, the reality is that liberating education is not in a growing government’s best interest. An education that teaches the proper affection toward liberty and a proper fear of consolidated power would threaten a growing government; thus, the state schools are incapable of giving you the tools needed to flourish. The government will use its schools to propagate the expansion of itself. (This we can already see.) At this rate, how many graduating classes currently stand between where we are at now and implementing and embracing absolute socialism?

The only mechanism to stop the suppression of liberty is to defund state education and the Department of Education. However, the moment you say that out loud, you had better expect a very loud and in-your-face question from an unimaginative population that screams, “BUT WHAT WILL WE DO WITHOUT STATE EDUCATION?!?”
 
Well, the first reality is that in the state of Iowa, where I live, $3.7 billion (thanks to the latest increase due to school choice policies) will flood back into the Iowa free-market education economy. Consequently, all sorts of options become possible.

Unsatisfied, the same doubters will insist that Iowans will not fund education through any other method than coercive taxation.

This also is no cause for alarm since, historically speaking, the free market has the potential to offer a higher quality education for less than 50 percent of the cost of government education.

Self-Fund or Secure Private Funding for Education?

But the ultimate concerns from skeptics will sound something like this: “What will happen if parents won’t self-fund or secure private funding for their children’s education? Will we end up with a population of uneducated children that will be a liability to our state? Consequently, it must be in our state’s best interest to fund and force government education on children.”

This question is powerful because it shows the true colors of our culture and reveals our flawed presumptions:

1. We presume that the state cares more for children than their parents.

2. We presume that the state is responsible for parental failures.

3. Finally, we reveal that we would rather trust our mechanisms of control than embrace the responsibility of freedom.

Because of this reality, the economics of the issue do not really matter.

Freedom Is a Dangerous Currency

Freedom is an invitation to responsibility, but it allows for the opportunity to embrace or reject that responsibility. Freedom does not protect from failure. The question has to be asked: do our states even want freedom? Does our nation? The Proverbs speak of two women, Lady Folly and Lady Wisdom, and the choice to be made. Similarly, in our modern context, there are also two women: Lady Liberty and the Lady “Nanny.” This choice is more fundamental than any political party, as the siren call from Lady Nanny beckons all. She whispers empty promises of safety and security and blinds us to the opportunity and blessings found with Lady Liberty.

Vote for Liberty

When election day arrives, there will be choices. Step one is to vote for candidates that are appropriately shutting out the Nanny’s calls. Step two, after election day, will you build relationships in your community and with those that represent you? Will you advocate for Liberty and warn against the deceptive promises of the Nanny?

Colorado Homeschool Freedom Prayer Update

“The Lord is a jealous and avenging God; the Lord is avenging and wrathful; the Lord takes vengeance on his adversaries and keeps wrath for his enemies. The Lord is slow to anger and great in power, and the Lord will by no means clear the guilty. His way is in whirlwind and storm, and the clouds are the dust of his feet.”

Nahum 1:2–3 ESV

The Lord sees all that we are dealing with and will by no means let it go unjudged. As I try to prepare for the next session, the storm clouds continue to build on the horizon. The power of those legislators holding a Marxist worldview is growing, and the rhetoric against God’s created order continues to confound reason. Meanwhile, I can only sit by and watch as those advocating for the growth of government through private-public partnerships as a way to disrupt the status quo in education build their kingdom which is antithetical to His kingdom. Yet, God’s power is greater, and His way is in the whirlwind and the storm!

There is no doubt a storm is coming, bringing destruction in its clouds. The exact characteristics of the storm remain hazy. Knowing the Lord is in the midst of the storm gives assurance to all who trust in His way. Yet, to stand on the edge of the storm as the winds howl and push against your resolve can be overwhelming. I am thankful that God has each of you praying for me, for His will to be done, and for the protection of His people. I am even more grateful that He allows me to meet many of you and thank you in person for upholding me and having a heart for the work He has me doing even when we can’t see the results.

Please continue to pray that I will be guided by His hand and remain steadfast in following His way as the storm clouds strengthen and build.

PRAISE!

  1. Praise God that He is IN the whirlwind and the storm!
  2. Praise God that He is trustworthy.

PRAY!

  1. Pray that God will allow me to speak the words He has ordained and those who hear them will listen.
  2. Pray that God will call more people to come to the Capitol to pray!
  3. Pray for the Lord to raise up an army to counter the lies spoken in His name.
  4. Pray for the hearts of the legislators God has called to the Capitol to be strengthened by His mighty power.
  5. Pray for His wisdom to be revealed to His people in order to overcome what is to come.
  6. Pray that God will protect His people from the repercussions of bad laws.
  7. Pray for His love to overwhelm those working at the Capitol who are seeking Him.
  8. Pray for God’s grace to abound and that the Senate will give us a room to pray in at the Capitol.

One such family – The Romeike’s – fled Germany to the United States to exercise this freedom, but are now facing deportation.

The Romeike family fled Germany for the United States in 2008 seeking asylum so that they could homeschool their children without fear of persecution. After more than a decade of making the United States their home, the Romeike’s were abruptly informed they had four weeks to return to Germany.

Tennessee Congresswoman Diana Harshbarger has introduced private bill H.R. 5423 to stop this deportation from happening and make the Roeikes eligible for an immigrant visa or permanent resident status.

Brushfires of Freedom

Early in our nation’s history, brushfires of freedom sustained our independence from a tyrannical empire. Other brushfires throughout our history brought forward a civil war, women’s suffrage, civil rights, abortion rights, marriage rights, and, more recently, gender rights. Not all these brushfires fulfilled the desired rallying cry of freedom because they were not grounded in God’s righteousness.

Today, a brushfire is sweeping across the nation calling itself “school choice.” A majority of state legislatures introduced bills this year to establish programs to fund private schools and home education.

Not a True Choice

In the early years of the homeschool movement, a spark grew into a brushfire of freedom in large part because families were willing to sacrifice for the cause. For the Christians in the movement, God’s command to disciple their children was the central driving force. They saw clearly the trajectory of the government schools and its goal of stealing the souls of their children. Despite the real threat of being imprisoned, following God was not an option; it was the only choice.

Purveyors of the school choice movement are trying to convince homeschoolers that government money provides a way for families to choose the best education for their children. But what they’re selling is a false choice. All the choices they are presenting will be ruled by government bureaucrats. We all inherently know: what the government funds, the government runs.

Most of the “school choice” bills introduced this year include bigger government and increased regulations for private and home educators who choose to accept taxpayer funds. Big, new government bureaucracies in partnership with private entities are built to manage the oversight of the funding. Requirements for homeschoolers using the funding often include frequent meetings with certified teachers, usage of curriculum tied to state standards, and yearly testing. Basically, it’s public school at home. A choice we’ve already rejected.

True Brushfires of Freedom

It is time to rekindle the sparks that began the homeschool movement some fifty years ago and revive the brushfire of educational freedom. Government-funded programs will never bring God’s truth to bear on the realities of this world. Brushfires begin within each heart and mind that is set on the truth of God’s Word. Jesus set us free and gave us liberty; it is this truth that God commands us to set ablaze in our children.

School choice advocates are relying on the greed of man to propel their cause. Politicians, nonprofits, and governments benefit from the enlargement of the government-funded and run education system and the number of people growing dependent on it. Yet, our cause rests in the humility of utter reliance on God for our very breath and a growing awe of who He is. The time has come to set afresh the brushfire that first brought us freedom and to lead others — especially our children — to the liberty found only in Jesus.
